Terms of Service

You must be at least 18 years old and legally able to enter into a binding contract to use paid or professional features. If you use the Services for a company, customer, property owner, team, or other organization, you represent that you have authority to accept these Terms on its behalf and to submit the information you provide.

Permitech organizes public permit information and user-provided project facts into tools for address and authority resolution, requirements research, evidence review, checklists, document and packet preparation, site-plan workflows, project collaboration, operational reporting, and permit tracking. Some Services include AI-assisted features, human-assisted review, managed Concierge work, or introductions to independent providers.

Feature availability and depth vary by geography, project type, permit type, plan, source quality, and product maturity. Labels such as supported, pilot, beta, research in progress, or unverified are part of the Service and must not be removed or misrepresented.

Permitech does not issue permits, approve plans, set fees, conduct inspections, grant variances, or control government review times. An authority having jurisdiction ("AHJ") and other reviewing agencies retain exclusive control over their requirements, interpretations, fees, portals, schedules, decisions, and records.

Some building departments use Permitech GOV under their own agreement with us. When you apply through a department's Permitech GOV workflow, the department, not Permitech, reviews your application and makes every decision on it, and the department's own rules and notices apply alongside these Terms. Permitech provides the software and the services the department asked us to provide.

Permit rules and public records change, conflict, and may be incomplete. Permitech attempts to show sources, quotations, verification status, dates, uncertainty, and jurisdiction context, but we do not guarantee that any requirement, form, fee, timeline, code edition, boundary, parcel fact, zoning result, or contact detail is complete, current, or applicable to a particular project.

Before relying on a result or filing, you are responsible for checking the cited source, confirming the property and project facts, resolving unclear or conflicting requirements with the responsible authority or qualified professional, and reviewing the final submission. Near-boundary, unincorporated, multi-authority, variance, floodplain, historic, utility, health, fire, and similar conditions may require additional review.

Permibot and other AI-assisted features may summarize sources, answer questions, read selected files or images, suggest tasks, identify possible requirements, or propose changes to project facts. AI output is probabilistic and can be inaccurate, incomplete, outdated, or unsuitable for your project. Citations and source links are provided to support review, not to eliminate it.

You must review AI output before acting on it, filing it, sharing it as authoritative, or allowing it to change a project record. You may not use the Services to make an automated decision that creates a legal, safety, employment, credit, insurance, housing, or similar high-impact determination about another person without appropriate human review and legal authority.

You agree to provide accurate information, maintain a current email address, protect your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account, devices, API credentials, team invitations, and project invite links until access is revoked or we are notified and have a reasonable opportunity to act.

We may require email, phone, business, license, insurance, or other verification for access to a plan, trial, referral opportunity, managed service, or higher-risk feature. Verification is an access and fraud-control measure; it is not an endorsement, license validation, or guarantee of professional quality.

Organization owners and administrators may invite or remove users, assign roles, manage access, view organization projects, and manage billing according to the available controls. Project invitees may receive access to selected project information. You are responsible for choosing appropriate access, removing users who no longer need it, and ensuring your use complies with customer and employee obligations.

If your account is controlled by an organization, the organization may manage the account and project content associated with its workspace. A dispute between an organization and its users does not require Permitech to determine ownership beyond our records and applicable law.

You retain ownership of content you submit, including project facts, comments, messages, documents, photos, plans, and other materials ("User Content"). You grant Permitech a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, display, modify for technical formatting, and use User Content only as reasonably necessary to operate, secure, support, and improve the Services and fulfill your requests.

What Permitech learns about a jurisdiction's rules while working on your projects, such as a requirement, its source and its verification, becomes part of Permitech's jurisdiction library without your name, contact details or street address, and remains there after you delete your account.

You represent that:

• You have the rights, permissions, and lawful basis needed to submit and use the User Content.
• Information about a property owner, employee, subcontractor, or customer is relevant to the project and handled with appropriate notice or consent.
• Uploaded plans, surveys, photos, licenses, bonds, insurance documents, and company-verification records are authentic and are not misleading, fraudulent, or unlawfully obtained.
• User Content does not infringe intellectual property, privacy, confidentiality, or other rights.

The Services may organize contractor licenses, registrations, permit bonds, certificates of insurance, and related expiration dates. A government-required license or bond is distinct from a contractor's private insurance program, even when the same AHJ asks for proof. Permitech tracking does not independently confirm coverage, standing, limits, endorsements, or eligibility unless a specific verification status expressly says so.

Contractors remain responsible for maintaining all licenses, registrations, bonds, insurance, and notices required by law, contract, customer, or AHJ. Customers should perform their own due diligence before hiring or relying on a provider.

Paid plans, one-time workspaces, add-ons, and managed services are billed at the price and interval shown at checkout or in an order form. Taxes and third-party charges may apply. Stripe processes payments and may apply its own terms to payment services.

Recurring subscriptions automatically renew for the selected monthly or annual interval until canceled. You authorize us and our payment processor to charge the payment method on file at each renewal. Annual subscriptions are generally charged upfront for the year. Cancellation takes effect at the end of the paid period unless the checkout, plan terms, or applicable law states otherwise.

Trial eligibility, duration, required business verification, included features, conversion date, and promotional terms are shown at enrollment. Unless you cancel before a trial converts, the subscription may automatically begin and the payment method on file may be charged. Promotional trials may be limited to selected users, companies, communities, channels, or one use per customer.

Except where required by law or expressly stated at checkout, fees already charged are non-refundable. If a payment fails, we may retry, suspend paid access, reduce entitlements, or terminate the subscription. You remain responsible for charges incurred before cancellation or suspension.

Plans may include limits on projects, seats, reviews, site plans, storage, AI use, research, messages, or other features. Usage counters and reasonable technical limits may be used to enforce a plan. We may adjust plans prospectively, add overage options, or retire features, but material pricing or renewal changes will be communicated as required by law.

Concierge, Done-For-You, permit technician review, site-plan preparation, and similar services are limited to the written scope accepted for that order. Deliverables, customer responsibilities, revision limits, target timing, excluded professional services, and filing responsibility may be described in the checkout, proposal, statement of work, or project workspace. If those terms conflict with these general Terms, the specific written service terms control for that order.

Target dates are estimates unless expressly guaranteed in writing. Government queues, customer delays, incomplete facts, professional design needs, portal outages, fees, inspections, and correction cycles are outside Permitech's control.

Permit Delivery is available only where the department requires an in-person drop-off or pickup and allows an authorized agent to make it. By ordering it, you authorize Permitech to act as your agent for that trip. We print to the sizes and scales the department requires, and the fee is quoted when the order is scoped. The department may still refuse, delay or return a submission, and its counter hours and rules are outside our control.

The referral network may introduce property owners, contractors, permit technicians, designers, or other providers. Unless expressly stated in a written agreement, providers are independent and are not employees, agents, partners, or representatives of Permitech. Permitech does not guarantee that a lead will respond, a provider will accept work, a project will be awarded, or either party will perform or pay.

Parties are responsible for evaluating each other, agreeing on scope and price, confirming licensing and insurance, executing their own contracts, and resolving project disputes. Referral fees or commercial relationships may be disclosed where applicable.

You may not:

• Use the Services unlawfully or to facilitate fraud.
• Submit false permits, credentials, insurance records, identities, ownership claims, or project facts.
• Access another user's account or project without authorization, bypass permissions, probe security, or interfere with operation.
• Upload malware, harmful code, illegal content, or sensitive data unrelated to a legitimate permit or business workflow.
• Scrape, copy, resell, or systematically extract the Services, source library, databases, or model outputs except through an authorized feature or written agreement.
• Reverse engineer or attempt to discover source code, models, prompts, or non-public systems except where law prohibits this restriction.
• Use automated traffic that exceeds documented limits or disrupts public government sources relied on by the Services.
• Misrepresent AI-generated, unverified, or estimated information as a government determination or professional certification.

Permitech and its licensors own the Services, software, design, trademarks, source organization, workflows, and original content, excluding User Content and third-party public materials. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Services for your personal or internal business permit operations.

If you provide feedback or suggestions, you grant Permitech a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation, provided we do not publicly identify you as the source without permission.

The Services may rely on or link to government portals, public records, GIS layers, map tiles, payment services, storage, email, analytics, AI models, and other third-party services. We do not control their availability, terms, accuracy, security, or content. Your use of a third-party service may be governed by separate terms.

We work to keep the Services available but do not guarantee uninterrupted or error-free operation. Maintenance, source outages, vendor failures, internet conditions, security events, and product changes may affect availability. We may add, change, suspend, or discontinue a feature. Beta, pilot, preview, and experimental features may change without notice and should not be relied on for a critical filing deadline without a backup process.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Permitech and its affiliates, officers, employees, and contractors from third-party claims, losses, and reasonable expenses arising from your User Content, your violation of these Terms or law, your unauthorized use of another person's data or property, or your professional or construction services. This obligation does not apply to the extent a claim results from Permitech's own unlawful conduct.

You may stop using the Services at any time and may cancel a subscription through the available billing controls. We may suspend or terminate access for nonpayment, security risk, fraud, legal requirements, material breach, harmful use, or discontinuation of the Services. Where reasonable, we will provide notice and an opportunity to cure.

Upon termination, your right to use the Services ends. Terms that by their nature should survive, including payment obligations, intellectual property, disclaimers, liability limits, indemnity, and dispute provisions, remain in effect. Data handling after termination is governed by the Privacy Policy and applicable law.

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Before filing a formal claim, you and Permitech agree to make a good-faith effort for at least 30 days to resolve the dispute by contacting the other party with a written description of the issue and requested resolution. Any court proceeding must be brought in a state or federal court with jurisdiction in Illinois, unless applicable law requires a different forum.

These Terms, the Privacy Policy, and any applicable checkout, order form, or written service agreement are the entire agreement for the Services they cover. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining terms continue. Our failure to enforce a term is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization or business transaction. Headings are for convenience only.

We may update these Terms prospectively. We will update the date above and provide additional notice for material changes when required. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
